NoSpill 5 Gallon Recall Announcement

November 20, 2009

No Spill Customers:

RECALL
We are announcing a recall of 5 gallon gas cans that shipped from our facility in Jefferson City MO August 10 through October 5. A small percentage of these cans may not have been milled correctly in a secondary operation that shaves excess plastic off the top of the can’s neck. The result is a surface that may not seal properly at the junction of the neck to nozzle assembly and it may leak. This will be obvious at first use.

To date we know of only a few problem cans. However with an abundance of caution, we have decided to proceed with a Fast Track Product Recall Program as prescribed by the Consumer Product Safety Commission (CPSC). I have spoken with Mr. Dean Woodard of the CPSC. Mr. Woodard is the Department Head of Section 15 that deals with product recalls and stepped me through the process. We are committed to working with the CPSC and following their guidelines and advice through this event.

UPDATE January 2010: Only 2% of recalled cans were found faulty.
Over 50% of the cans affected by the recall have been returned and inspected. We found that 98% were completely leak free. Therefore, if you have customers retuning recalled cans to your store ask them if they have leaked. If not, they are good to go, their current No Spill 5 gallon can is not part of the recall if it doesn’t leak.

DATE CODES
Our investigation is not yet complete. At this time this recall affects only our 5 gallon gas containers manufactured with the Julian date codes AIP09202 through AIP09222. (July 21-Aug 10) If the containers do not have this date code string on the bottom of the can they are not part of this recall. There were 7,488 five gallon cans manufactured during the production run that may be affected. While only a small percentage of these cans are potentially affected, we are requiring all of them to be returned to us by all No Spill distributors and dealers.

WHAT RETAILERS SHOULD DO
If you received 5 gallon gas cans from us or a distributor this summer and fall:

  1. Post the attached Safety Recall poster in your store for at least 120 days.
  2. Check your inventory for cans with the above date code string. Do not attempt to leak check them yourself. If you have them, contact us so we can arrange shipping back to us. Best way is email to recall@NOSPILL.com . We will respond with shipping instructions. We will replenish your inventory within a couple weeks or sooner
  3. If you sold these cans to a consumer and have records of who has the affected cans, please contact us with that information and forward the attached Safety Recall poster to them.

GOING FORWARD
We have spot inspected our current 5 gallon inventory and are now inspecting each container of both finished and unfinished inventory in Jefferson City. This inventory is from a different production run than the cans in question and we have yet to find a similar problem. After inspection, we will be shipping this double checked inventory allowing you as our customers to sell our 5 gallon containers again.

In a few months, we will switch to new molds that will finish the neck of the cans during the molding process and eliminate this secondary operation involved with the recall. As you may imagine, this recall experience is causing us to expedite our new mold schedule.

We will do all we can to handle this unfortunate situation correctly and restore your confidence in our processes and product.
